Charges Dismissed Against Witness in Ohio Foster Child Death
MAYSVILLE, Ky. (AP) A circuit court judge has dismissed charges against a woman who allegedly helped hide the remains of an Ohio foster child.
Judge Lewis Nicholls threw out the charge of tampering with physical evidence against Amy Baker because of concerns of prosecutorial ambiguity.
Baker was arrested last April on charges that she tampered with evidence by helping to destroy and hide the remains of 3-year-old foster child Marcus Fiesel. She was a key witness in the Ohio murder case against David Carroll and his wife Liz and was granted immunity in that state in exchange for her testimony.
Nicholls, however, said prosecutors erred during negotiations on whether Baker would receive immunity in Kentucky for testifying against the Carrolls.
